Limited License Agreement

By purchasing a DJ Inkers' product, you are agreeing to our terms of use. Our products are ONLY for the use of a single purchaser. Sharing, posting online, reselling or redistributing digital images and/or fonts (in original format or as part of a kit/bundle) is a copyright violation.   

Please help keep us in business and be respectful of our terms and our artwork.

The purchase of DJ Inkers' clip art and/or fonts now includes a 'limited licensing agreement,' with usage extending to personal, educational and limited commercial use. Details and terms for different usage types are listed below.

DJ Inkers graphics and fonts are to be considered design components. You must create a new project or derivative work using our designs for this license to apply. (Simply adding a border or layering multiple images does not constitute a new derivative design.)  The item/project for sale must be created by you (the purchaser).

This license agreement is between DJ Inkers and the individual purchaser, and is non-exclusive, non-transferable and non-assignable. This license does not extend to publishers, large corporations or manufacturers.  Upon purchasing a license it is recommended that you review the license to ensure your desired usage falls in line with the terms and permitted uses listed in this agreement.  If DJ Inkers' Limited License Agreement does not include your desired usage, please consider our VIP Commercial License Agreement or  contact us to discuss your project or small business needs.

Crediting DJ Inkers

Visible credit for DJ Inkers is required on ALL digital products (free or paid). Simply include the text "Created using clip art and/or fonts © DJ Inkers: www.djinkers.com." This can be done on a credits page, product cover &/or the product description of each derivative work. A clickable link back to DJ Inkers' website is preferred, if possible.

Visible credit for DJ Inkers is required on ALL tangible/physical products sold for profit. This can be done on a label, tag, sign or online product description including the text: "Created using clip art and/or fonts © DJ Inkers: www.djinkers.com."

If you, the purchaser, use DJ Inkers clip art and/or fonts to create a derivative work/project to sell, post anywhere online or share (with a team member, parent, school etc.), the images/pages created must be either: A) secured in a 'view only' PDF with a password to prevent saving or copying the images. B) 'flattened' or rasterized as part of a fixed slide, background or page. (ie. jpg format)

ALLOWED

Personal Use

  • Examples include: personal greeting cards, invitations, calendars, bookmarks, scrapbooks, printable projects, crafts, flyers, announcements, t-shirts, die-cut crafts
  • Birthday, wedding, shower and party items such as decorations, party favors, games, nametags, cake toppers, wrappers, gift bags
  • Non-profit items for non-profit organizations (Please credit DJ Inkers whenever possible.)

Educational Use

  • Examples of allowed educational use projects include: classroom worksheets, lessons, bulletin boards, decorations, labels, workbooks, activities, printable projects, games, notes, event posters, certificates, programs, binder covers, progress reports, report cards
  • Classroom Smart Board lessons, PowerPoint, Google Slides, Google Classroom, TPT Easel and Boom Card activities (used for your students/classroom)
  • Classroom or school communications or publications such as newsletters, event posters, signs, handouts, programs, certificates and school yearbooks (Please credit DJ Inkers whenever possible.)

Limited Commercial Use

  • Any project that is sold for profit and uses DJ Inkers' clip art &/or fonts requires commercial credit (see above). This license is NOT for manufacturers, publishers, large corporations or for use in mass production.
  • No tangible/physical derivative product may be reproduced more than 250 times (total) under our limited license.  Please consider our VIP commercial license or contact us regarding large scale production or enhanced licensing options.
  • No digital derivative product may be sold more than 500 times (total sales combined from all websites & venues) under our limited license.  Please consider our VIP commercial license or  contact us regarding large scale production or enhanced licensing options.
  • Acceptable venues to sell from may include (but are not limited to): Teachers Pay Teachers, Teachers Notebook, Etsy, Boom Learning, blogs, small commercial or non-profit websites, boutiques, farmer & local markets etc.
  • DJ Fonts (OTF and TTF files) may be used to create text-based digital designs for commercial use, but the font itself cannot be resold or re-distributed.
  • Permissible small business signage usage includes: seasonal signage, product signage, open and closing signs, business hours, etc. Images must be integrated into a design and complement the text.
  • Permissible printed business usage includes: menus, stationery items, posters, postcards, bookmarks, flyers, newsletters etc. Images must be integrated into a design and complement the text.
  • Small handcrafted items that are sold for a profit and create a new derivative design, ie. handmade greeting cards, invitations, postcards, ornaments, glassware, mugs, t-shirts
  • Digital educational lessons and activities for Smart Board, PowerPoint, Google Slides, Google Classroom. Images must be flattened as part of a fixed slide/background and not loose in the file. Images within these files must be non-removable and non-editable. Text boxes layered on a flattened slide allowing a student to enter an answer is acceptable.
  • Digital lessons on TpT Easel or Boom Learning are permitted with DJ Inkers' limited license. Moveable pieces are permitted, but credit must be given to DJ Inkers for any graphics or fonts used in the product description.

NOT ALLOWED

  • You may NOT display a standalone DJ Inkers' image on the internet in any format, for any reason (whether it's a website, blog or store page). This is strictly prohibited.
  • You may NOT resell, share or redistribute DJ Inkers' clip art, fonts or finished projects/printables.
  • You may NOT use DJ Inkers clip art or fonts to create your own products that resemble any other DJ Inkers product(s) and will compete with djinkers.com.
  • You may NOT recolor and/or modify and/or repackage and/or reformat DJ Inkers clip art or fonts without adding designs to create a derivative work. You must add a substantial amount of new material to create a new derivative product.
  • You may NOT use DJ Inkers clip art or fonts as a part of a business logo, sign, trademark, or service mark. (We do, however, offer logo and mascot design services. Contact us with details about your project or business needs for a free estimate.)
  • You may NOT use DJ Inkers clip art or fonts to create embroidery designs, rubber or digital stamps, stickers, digital stickers, coloring books, SVG die-cut files, clothing, board games, diaper products or toys sold for profit. (Please contact us with any questions or for a project design estimate.)
  • You may NOT use DJ Inkers clip art or fonts to illustrate published books or workbooks that are sold for a profit. (Contact us with any questions or see our full commercial license.)
  • You may NOT use DJ Inkers clip art or fonts for print-on-demand sites of any kind.
  • You may NOT use DJ Inkers clip art or fonts for website or blog templates, digital collage sheets, digital papers or backgrounds, digital greeting cards, graphic design services or graphics-based products sold for profit or commercial purposes.
  • You may NOT use DJ Inkers clip art or fonts for iPhone, iPad, Android, Facebook, Tiny Tap apps, online presentation sites, software design, or embedded art in software or websites.
  • You may NOT sell, rent, give, sublicense, or transfer your projects/derivative designs OR your DJ Inkers art, fonts or licenses to another company or individual seller for any reason.
  • You may NOT use DJ Inkers' clip art or fonts to directly or indirectly infringe on the intellectual property of another party, including copyright, trademark or service mark.
  • You may NOT use DJ Inkers' clip art or fonts to make political statements or social commentary in any format, including online, social media, or printed formats
  • You may NOT use DJ Inkers' clip art or fonts in a derogatory or defamatory manner.

DJ Inkers reserves the right to update or amend this Limited License Agreement at any time. Notice will be posted on our website any time our terms are updated.

The purchaser or licensee agrees to be bound by any update to the terms of this license.

We retain the right to review, remove or discontinue any product and deny specific usages at our discretion, based on our interpretation of what constitutes a derivative work.

You may terminate the agreement by discontinuing all use of DJ Inkers graphics and fonts on all of your commercial projects/products. Failure to comply with the terms of this Limited License Agreement may result in the license being terminated at the sole discretion of DJ Inkers.

This agreement shall be construed and interpreted in accordance with the laws of the State of Florida, which the parties agree, shall be the sole and exclusive jurisdiction for any suit or cause of action based upon or arising out of this agreement.

All DJ Inkers download purchases are final. Links are valid for 7 days and can be found on your check-out invoice, email or order history on our website. We are happy to refresh your purchases for free any time. Just email smiles@djinkers.com with your request.
